    1.1 The content of the pages of this website is for your general information and use only. It is subject to change without notice

    1.2 This website uses cookies to monitor browsing preferences. If you consent to the use of cookies, your browsing & purchase activity on this site may be stored by us and processed by third parties for analysis and marketing purposes.

    1.3 By entering your details on this website either as part of a sale, to contact us or subscribe to email lists, you confirm that you agree to our Privacy Policy.

    1.4 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

    1.10 Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Northern Ireland, Scotland and Wales.

    2. Conditions Applicable

    2.1 These Conditions shall apply to all contracts for the sale of Goods by OK Vape Ltd to the Buyer to the exclusion of all other terms and conditions including any terms or conditions which the Buyer may purport to apply under any purchase order confirmation of order or similar document. These conditions will prevail over any other information supplied to the Buyer or displayed on our website.

    2.2 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these conditions.

    2.3 The contract for sale of the Goods shall not be concluded until OK Vape Ltd has confirmed the order to the Buyer either by email, phone or fax.

    2.4 Acceptance of delivery/collection of the Goods shall be deemed conclusive evidence of the Buyer's acceptance of these conditions.

    2.5 Any variation to these conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by OK Vape Ltd.

    3. The Price & Payment

    3.1 The price shall be the price set out in the order for the Goods.

    3.2 Payment of the Price shall be due with the order.

    3.3 We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). We reserve the right to alter all product pricing without notice.

    3.4 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.

    3.5 Payment can be made by Visa, Delta, Solo and Mastercard. These payments will be processed by Checkout.com or Opayo. We do not currently accept American Express. You may also make payment by cheque - please contact us for further information.

    3.6 We may refuse in our discretion to accept an order:

    (a) where we cannot obtain authorisation for your payment;
    (b) if there has been a pricing or product description error; or
    (c) if you do not meet any eligibility criteria set out in our terms and conditions.
    (d) where goods ordered by you are not available;
    (e) if we do not deliver to your area;
    Where we do not accept your order but have processed your payment, we will re-credit your account with any amount deducted by us from your debit or credit card as soon as possible, but in any event within 30 days of your order. We will not be obliged to pay any additional amount as compensation for disappointment.

    3.7 Kudos Rewards Loyalty Scheme Terms & Conditions

    To take part in our loyalty program, all terms and conditions must be accepted by the user, including any subsequent updates. By registering and taking part in our reward program you are taken to have read and agreed to these terms.

    3.7.1 You must create a customer account on the OK Vape website in order to earn Kudos Reward points in our OK Kudos scheme. Please make sure you are logged into your account before placing an order so that you can benefit from the scheme.

    3.7.2 The maximum number of points that can be redeemed at any time is 520 Points for a £26 discount.

    3.7.3 Points will expire 12 months after the date on which they were earned, and the redeemed discount codes expire after 6 months if left unused.

    3.7.4 Kudos reward discounts may not be used in conjunction with any other discount codes.

    3.7.5 Points have no cash value value and are non-transferable.

    3.7.6 We give no verbal, written or implied warranty about any rewards provided under our loyalty scheme. In particular, we do not represent that any particular reward is suitable for a particular purpose for which you intend to use it.

    3.7.7 Except to the extent provided by law we do not accept any liability for:

    • The loss, theft or destruction of a Reward;
    • Loss arising from the death, injury or consequential loss arising from the supply of a Reward; or
    • Any disruption to rewards, delay or inability to provide a reward caused by circumstances beyond our control like industrial disputes or acts of God

    3.7.8 We reserve the right to withdraw the Kudos Rewards scheme at any time.

    Examples of when we may terminate include, but are not limited to:

    • Where you are in default under these terms and conditions or the terms and conditions of another facility that the customer has with us;
    • Where we believe on reasonable grounds that the continued operation of the account may cause loss to the Customer or us;
    • A change of applicable laws or regulations.

    These examples are for guidance only and do not limit our ability to terminate the scheme.

    3.7.9 We reserve the right to terminate or change the earning conditions, rates and rewards of the Kudos Reward scheme, and without notice.

    3.7.10 Where applicable, Customers will be made aware of any changes to our Loyalty Scheme via email and on the Kudos Rewards page of this website.

    3.8 Saved Card Terms

    You may choose to save a payment card on your account for faster checkout. Please read and ensure that you agree to the following before saving your card details.

    How Do Saved Cards Work?

    When you save a card, your card number and expiry date are encrypted into what's called a 'token'. This means that your card details cannot be read or accessed by anyone else, so it's very safe to do so. Our payment provider then uses this token to take future payments when you place an order using a saved card.

    Saved Card Agreement

    Consent
    By choosing to store your card details, you consent to us taking payments for future purchases you make on this Website, from the specified payment card. We will only take a payment when you use the saved card details to place an order with us.

    Security
    Your card details will be 'tokenised' and securely stored in our payment gateway, Checkout.com's vault. You can find more details about Checkout.com and their security credentials on their website.

    Notification of Changes
    If any changes are made to this consent agreement, we will notify you by email.

    Agreement Term & Cancellation
    The consent agreement will apply until such a time that the card details expire, or you remove your saved card details from your account. Card details can be deleted at any time from the 'Saved Cards' tab within you account. Doing so will end this agreement between Yourself & OK Vape.

    3.8 Checkout.com

    Our Payment Service Provider is Checkout.com - the UK's highest valued financial technology company.

    Checkout.com are PCI DSS (Payment Card Industry Data Security Standard) Level 1 compliant, the highest and most stringent standard set by the payment card industry to ensure that credit card data is processed, stored or transmitted in a secure environment. Checkout.com have set extremely high standards for data security and have security measures in place to prevent personal data from being accidentally lost, used or accessed, altered or disclosed in an unauthorised.

    Being PCI DSS Level 1 compliant, Checkout.com are subject to regular security audits, including; Annual report on compliance prepared by the Qualified Security Auditor, Quarterly network scan by Approved Scanning Vendor, Penetration Tests and Internal Scans.

    Checkout.com is an active member of the PCI Security Standards Council (PCI SSC) that defines card industry global regulation. In addition, you know that your session is in a secure encrypted environment when you see https:// in the web address, and/or when you see the locked padlock symbol alongside the URL, so when buying through our site, you can be sure that you are completely protected.

    3.9 Opayo

    Our Payment Service Provider is Opayo (formerly SagePay) - one of the largest independent payment service providers (PSP) in the UK and Ireland.

    Opayo provides a secure payment gateway (Level 1 PCI DSS), processing payments for thousands of online businesses, including ours. It is Opayo's utmost priority to ensure that transaction data is handled in a safe and secure way. Opayo use a range of secure methods to protect payments made through their gateway, such as fraud screening, I.P address blocking and 3D secure. All sensitive data is secured using internationally recognised 256-bit encryption standards.

    Opayo are PCI DSS (Payment Card Industry Data Security Standard) compliant to the highest level and are subject to regular security audits. They are also regularly audited by the banks and banking authorities to ensure that their systems are impenetrable.

    Opayo is an active member of the PCI Security Standards Council (PCI SSC) that defines card industry global regulation.     3.10 PayPal

    PayPal have withdrawn their services as a payment processor for websites selling vaping products. Unfortunately this means that we are no longer be able to offer it as a payment method.

    We offer the option to save your card at checkout, so it’s still quick and easy to place an order. Please note that this option is only available to customers who have an account.

    4. The Goods

    4.1 The quality and description of the Goods shall be as set out in the Order. We have taken care to describe and show items as accurately as possible. Despite this, slight variations in items may occur. If there is anything which you do not understand, or if you wish to obtain further information, please contact our Customer Services team at info@okvape.co.uk.

    4.2 OK Vape Ltd may from time to time make changes in the specification of the Goods which are required to comply with any applicable safety or statutory requirements or which do not materially affect the quality or fitness for purpose of the Goods. Also, OK Vape Ltd do not warrant that the colour of the Goods will exactly match the colour shown on the website.

    5. Eligibility

    5.1 Users of this Site and any products sold on this Site must be over the age of 18. We perform age verification checks to ensure the sale of products to over 18's only. You can find out more about these checks in our Privacy Policy. We have taken all possible and necessary measures to ensure that persons under 18 cannot purchase these Products.

    5.2 These Products are intended for use only by smokers.

    6. Warranties And Liability

    6.1 OK Vape Ltd warrants that the Goods will at the time of delivery/collection correspond to the description given by the Seller (subject to the terms of clause 4.2).

    6.2 Products purchased via this Site must only be used in accordance with the instructions provided with the products and/or on this Site. OK Vape Ltd accept no responsibility for damage, loss or injury caused by improper use of the products sold. The Buyer must be aware of the following details:

    6.2.2 Where stated on the packaging, our e liquids and cigalike refills contain nicotine. Nicotine can be a toxic and addictive substance. Nicotine-containing products are only intended for use by smokers aged 18+ and are not intended for children or pregnant women. If you have any pre-existing conditions, you should consult your doctor before using products containing nicotine.

    6.2.3 Any e liquid or cigalike cartomizer containing nicotine may be harmful if ingested in sufficient quantities; with a risk of fatality should it be consumed by a child. Other ingredients may be harmful to animals (even if the e-liquid does not contain nicotine). In the case of accidental ingestion, medical advice should be sought if you feel unwell (or immediately in the case of ingestion by a child) and the doctor shown the bottle and packaging from which the product was consumed. All of our e-liquid and refill cartomiser (whether nicotine-containing or otherwise) products must be safely stored when not in use. They must be kept out of the reach of children and animals at all times.

    6.2.4 Skin contact with e-liquid may be harmful and should be avoided wherever possible. If the product comes into direct contact with the skin, the affected area should be washed with plenty of soap and water. If the product comes into contact with the eyes, the affected area must be rinsed thoroughly and medical advice sought. If e-liquid is spilled onto clothing, this should be washed before reuse.

    6.2.5 Do not eat, drink or smoke when handling e-liquids and wash your hands thoroughly after handling any e-liquid product.

    6.2.6 Whilst every measure has been taken to make our packaging child-proof and all appropriate explicit warnings and cautions explicitly provided on packaging and labelling, we cannot be held responsible for any personal injury arising from or attributable to a failure to comply with the warnings and instructions as listed in this clause or from failure to use any product as intended or in accordance with the instructions provided with that product.

    6.2.7 E Cigarette devices and batteries must only be charged with the charging equipment supplied by the Seller. Adaptors for charging other devices (such as phone charging adaptors) must not be used to charge any electronic cigarette batteries.

    6.2.8 The Buyer must adhere to our Battery Safety Information. Ok Vape will not be liable for any fault or incident that arises from not adhering to these safety guidelines.

    7. Returns

    7.1 Should you change your mind about an item you have purchased from OK Vape, you have 14 calendar days from the day after the item is received to let us know you would like to return the item for a refund. Please return the item to us within 14 days in unopened/unused condition and we will issue a full refund. Please allow up to 14 days to receive the refund.

    7.2 Items that are faulty or damaged on delivery must be reported to OK Vape within 30 days of receipt.

    7.3 Items that have been dispatched incorrectly by OK Vape will be replaced, and a prepaid returns label issued to return incorrectly sent items. You will be sent a link to print off a returns label. If the items you are returning exceed the accepted weight/size, please contact us to organise a courier collection.

    7.4 Returns of unopened, unused items may be accepted at our discretion no more than 30 days after purchase.

    8. Guarantees

    8.1 E Liquids and cigalike refills are consumable items sold in sealed packaging and are not covered by a guarantee.

    8.2 Any defect of an OK Vape branded electrical item that arises due to faulty materials or workmanship will be repaired or replaced free of charge up to 12 months after purchase where the customer can provide proof of purchase.

    8.3 Products manufactured by external brands (e.g. Aspire, Innokin, Uwell) hold a 3 month warranty from date of purchase. Outside of this time, we regret that items are non-returnable. Items that arrive or become faulty within 3 months from purchase may be returned for replacement. Please contact us if you experience an issue with any products purchased from this website.

    8.4 The guarantee is subject to the following provisions:

    8.4.1 The Guarantee is only valid within the boundaries of the country of purchase.

    8.4.2 The product must be correctly operated in accordance with the instructions provided with the product and within the information sections of this website.

    8.4.3 The guarantee does not cover accidental damage or misuse, such as the use of non compatible products.

    8.4.4 The guarantee will be rendered invalid if the product is re-sold or has been damaged by an attempted repair.

    8.4.5 The manufacturer disclaims any liability for incidental or consequential damagesThe guarantee is in addition to and does not diminish your statutory or legal rights.

    9. Delivery of Goods

    9.1 We offer a free delivery option on orders over and including £20.00 via the Royal Mail Tracked 48. We also offer the option to choose Royal Mail Tracked 24, Royal Mail Special Delivery Guaranteed by 1pm or DPD Next Day delivery for a small fee. Your order may require a signature upon delivery. If you are not available to accept an order, the standard terms of Royal Mail or DPD deliveries will apply. This will usually involve a card being left and your order being delivered to a local collection office, or a re-delivery attempt made the next working day.

    9.2 We process your order as soon as possible and endeavour to do this the same day when received before 2pm Monday to Friday or 10am Saturday. Orders received between 2pm Friday & 10am Saturday will be dispatched on Saturday. Orders received after 10am Saturday will be dispatched on the following Monday. On rare occasions, we may not be able to dispatch an order the same day, an item may be out of stock or unavailable and can take longer than the stated delivery time. In this case we will attempt to contact you to inform you of delays. We are unable to give exact delivery dates except where Next Day delivery services have been purchased within the correct terms and in which case the liability will then fall with Royal Mail or DPD, who provide the service.

    9.3 Our Next Day services apply to orders received before the above dispatch cut-off times. Please note that these are next working day services. We will provide an estimated delivery date at the basket stage of checkout for your information. In exceptional cases it may not be possible for our couriers to deliver the next day, therefore these services are not guaranteed. You will receive full tracking and delivery time slots for orders sent via these services.

    9.3 Once items have been dispatched by us, we hold no liability for damage, loss or delay.

    9.4 We accept no liability if incorrect address details given with your order lead to loss, delay or non-delivery. Please ensure you provide the correct details when ordering.

    9.5 You may contact us to request dispatch of your order at a later date and we will endeavour to meet your requirements.

    9.7 If the package does not appear to be in good condition or items have been damaged, please contact us as soon as possible so that we can put in a claim with the delivery provider.

    9.8 Please open all boxes or parcels as soon as they arrive, you have 7 days to notify OK Vape Ltd of any damage, shortages or incorrect items seemingly not caused by delivery. If we are not notified of damage, shortages or incorrect items within this time, you agree to indemnify OK Vape Ltd in full against any losses we suffer as a result of your failure to notify us within 7 days.

    9.9 We offer delivery to mainland UK, including the highlands, islands and Northern Ireland.

    10. Acceptance of the Goods

    10.1 The Buyer shall be deemed to have accepted Goods 24 hours after collection or delivery to the Buyer

    10.2 After acceptance the Buyer shall not be entitled to reject Goods which are not in accordance with the contract.

    11. Title and Risk

    11.1 Title shall pass on delivery/collection of the Goods.

    11.2 Risk shall pass on delivery/collection of the Goods.

    12. Remedies of the Buyer

    12.1 Where the Buyer rejects any Goods (where the Buyer is entitled to reject the Goods) the Buyer shall have no further rights whatsoever in respect of the supply to the Buyer of such Goods or the failure by OK Vape Ltd to supply Goods which conform to the contract of sale.

    12.2 Where the Buyer accepts or has been deemed to have accepted any Goods then OK Vape Ltd shall have no liability to the Buyer in respect of those Goods.

    12.3 OK Vape Ltd shall not be liable to the Buyer for late delivery of the Goods.

    12.4 OK Vape Ltd shall be under no liability whatsoever to the Buyer for any indirect loss and/or expense (including loss of profit) suffered by the Buyer arising out of a breach by OK Vape Ltd of this contract.

    12.5 In the event of any breach of this contract by OK Vape Ltd the remedies of the Buyer shall be limited to damages. Under no circumstances shall the liability of OK Vape Ltd exceed the Price of the Goods.

    13. Supply Of Goods Only

    13.1 The Buyer acknowledges that OK Vape Ltd is simply a supplier of Goods and any installation or fitting of the Goods is the sole responsibility of the Buyer.

    14. Right to Cancellation

    14.1 The following cancellation terms apply under the Consumer Contracts Regulations.

    These regulations apply to contracts of sale entered into on or after 13th June 2014. You should download and complete a cancellation form which can be downloaded here. The completed form can be sent as an attachment by email to info@okvape.co.uk or by post to:

    You then have a further 14 days within which to return the goods to us in their original unopened, unused condition.

    14.2 In the event of cancelling the contact, you, the Buyer, will be liable for paying the costs of returning the goods to us and must obtain proof of postage.

    14.3 On receipt of the returned Goods and provided they are in an opened, unused condition, you will be refunded the full value of the order, including basic postage charges, less any costs incurred for recovering the goods should these apply. Your refund will be issued within 14 days of receiving the returned Goods.

    14.4 Where you have purchased additional delivery services (e.g. Next Day delivery), the additional delivery costs will not be refunded.

    15. Complaints Handling Procedure

    15.1 To ensure that complaints can be investigated and resolved quickly and satisfactorily, OK Vape has a clearly defined procedure for managing customer complaints. Details of this procedure, and what you should do if you would like to make a complaint, are specified below:

    A member of our customer service team will investigate and, where possible, aim to resolve the issue directly within 2 working days.

    In most cases, no further action should be necessary. However, should a member of the customer service team be unable to resolve the complaint, it will be escalated to a senior member of staff who will respond to you within 2 working days.

    Customer's who are not satisfied with the resolution or explanation provided may then make a formal written complaint to the Managing Director who will respond within 14 working days of receipt.

    In the event that all the above procedures have been followed and completed without eliciting an acceptable response or proposed resolution, you can raise a dispute via the EU Online Dispute Resolution platform, accessible here: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show/ 

    16. Proper Law of Contract

    16.1 Sales on this website are governed by English law and you agree to submit any dispute to the non-exclusive jurisdiction of the English courts. All orders are subject to these terms and conditions and no amendments will be accepted by us. These terms and conditions do not affect your legal rights.

    16.2 These terms and conditions only cover the OK Vape web site (https://okvape.co.uk). Any other web sites to which you link from this site may be governed by their own terms and conditions. We accept no responsibility or liability for the content of web sites which are not under our control.

    17. OK Vape Subscriptions

    In order to place and receive subscription orders from OK Vape, you must give your consent. When you place an order for a subscription product, you will be asked to read and agree to the following subscription consent agreement.

    A copy of this consent agreement will be stored by ourselves, with a copy sent to your email address for your records.

    OK Vape subscriptions are not a contract and can be cancelled at any time, by either party. more information on how OK Vape subscriptions work can be found in our subscription FAQ's.

    17.1 Subscription Consent Agreement

    Recurring Payments

    By choosing to purchase a subscription, you agree to us using the card details entered to place your initial order to take scheduled payments at the transaction amount (in £GBP) stated in this order, in return for the scheduled deliveries of the items specified. This is not a direct debit but a Continuous Payment Authority (CPA) which permits us to take recurring payments, and can be cancelled at any time. All payments are handled by our secure payment gateway provider, Checkout.com. You can find out more about them and their security credentials in our Terms & Conditions.

    The recurring payments will be taken on or around the same day at which you place this initial order. You can change the payment date by suspending your subscription and reactivating it on the day that you would like the monthly payments to be taken.

    Notification of Changes

    If any changes are to be made to this consent agreement, we will notify you by email prior to the changes being made.

    Agreement Term & Cancellation

    The agreement will apply until such a time that either party cancels the subscription.

    You can suspend or cancel this subscription at any time from the ‘Subscriptions’ tab in your account, or in writing by emailing us at info@okvape.co.uk.

    18. Competition Terms & Conditions

    By entering the prize draw you are agreeing to these prize draw terms and conditions.

    18.1 The prize draw is being run by OK Vape Ltd

    Eligibility to enter

    18.2.1 The prize draw is open to entrants residing in the UK and over 18 years of age only

    18.2.2 In entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. We may request proof of age from prize winners who have not been previously age verified when ordering from the OK Vape website.

    18.2.3 Entrants must place an order between 8:00pm on 25/11/2021 and midnight on 29/11/2021 in order to gain entry to the competition.

    18.2.4 A maximum of 1 entry per individual is permitted.

    18.2.5 The prize draw is free to enter, however a successful order with a value of over £1.00 must be placed in order for an entry to be counted.

    How to enter

    18.3.1 Entrants must submit an order on the OK Vape website with a value of at least £1.00, between the dates specified above to gain an entry.

    18.3.2 OK Vape will contact the winner via the phone number or email used when placing an order. OK Vape will not accept responsibility if contact details provided are incomplete or inaccurate.

    18.3.3 Orders placed before 8:00pm on 25/11/2021 or after 11:59pm on 29/11/2021 will not be counted as an entry.

    18.4.1 One winner will receive 1 x £100 OK Vape gift voucher, valid for use on the OK Vape website. 2 winners will receive 1 x £20 OK Vape gift voucher, valid for use on the OK Vape website.

    18.4.2 Winners will be drawn at random.

    18.4.3 The prizes are non-exchangeable, non-transferable and no cash alternatives will be offered.

    18.4.4 The decision of OK Vape Ltd regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.

    Winner Announcement

    18.5.1 The winners will be notified on the 1st December 2021 via the phone number provided when placing their order.

    18.5.2 OK Vape will attempt to contact winners twice by phone, and twice by email.

    18.5.3 If the winner does not respond to calls or emails notifying them of their win within 14 days of the second effort to contact, they will lose their right to the prize, and OK Vape reserves the right to choose and notify a new winner

    Receipt Of The Prize

    18.6.1 Prizes will be allocated and sent to the winners email address with a store credit voucher code, redeemable online. Store credit can also be redeemed over the phone.

    Data protection and publicity

    18.7.1 You consent to any personal information you provide in entering the prize draw being used by OK Vape for the purposes of administering the prize draw and those purposes as defined within our privacy notice.

    18.7.2 All entrants may apply for details of the winning participant by contacting us at info@okvape.co.uk

    18.7.3 The winners agree to the release of their first and last name to other prize draw participants if requested via OK Vape

    18.7.4 An announcement of the winner's first and last name will be made via the OK Vape website and in email correspondence to other entrants, except where the winner has requested otherwise.

    18.7.5 All personal information shall be used in accordance with OK Vape Ltd's Privacy Notice.

    Limitation of Liability

    18.8.1 OK Vape Ltd does not accept any liability for any damage, loss, injury or disappointment suffered by any entrants as a result of either participating in the prize draw or being selected for a prize.

    General

    18.8.1 OK Vape Ltd reserves the right to cancel the prize draw or amend these terms and conditions at any time, without prior notice.

    18.9.2 The prize draw and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
